公安部提醒民众警惕对外劳务输出领域经济犯罪

公安部网站日前发布提示，要求民众警惕当前对外劳务输出领域经济犯罪，并欢迎及时向当地公安机关举报此类犯罪线索。

　　提示说，近年来，中国对外劳务输出领域经济犯罪多发。上海、山东、江苏、福建、辽宁等地公安机关陆续立案查处了一批案件。此类案件损害了出国劳务人员的合法利益，影响了中国的对外劳务输出市场秩序，易造成不良的国际影响。希望广大人民群众提高警惕，谨防上当受骗。

　　对外劳务输出领域经济犯罪的主要犯罪手段及特点：

　　(一)犯罪主体复杂，以非法劳务中介机构为主。其中，大多数是既无工商注册又无劳务输出资质的“黑中介”，少数是通过挂靠方式获得有劳务输出资质公司委托的合法中介，还存在极个别合法中介人员与他人相勾结共同实施犯罪的现象。

　　(二)犯罪手法主要是骗取出国保证金、培训费等费用。犯罪分子以虚假的优越工作条件、高额收入为诱饵，有的甚至通过电视、报刊等媒体发布虚假广告，引诱受害群众与其签订出国劳务合同，以需要进行语言、技能等培训为由索取高额培训费及各种名目手续费，并在收取费用后逃匿或恶意推诿、不履行合同。有的采用办理旅游签证、商务签证等方法将劳务人员输往境外，劳务人员出境后只能打黑工或根本无工可做。

　　(三)受害人数多，且主要是弱势群体。此类案件多属涉众型案件，受害人主要来自农村经济落后地区和城市低收入人群。他们受教育程度较低，信息渠道窄，自我保护意识弱，同时求富心切，急于摆脱生活窘境，因此极易受到蛊惑。不少人举债交纳出国费用，受骗后更是债台高筑，走投无路之下到政府部门聚众求助、上访，影响社会稳定。

　　(四)损害中国国家形象，造成不良国际影响。劳务人员非法出境后无工可做，长期滞留境外，人身安全得不到保障，不少人向当地驻外使馆求助、上访，常伴以过激行为。近年来，屡次发生中国出国劳务人员因经济纠纷或被诈骗后滞留境外的事件，极大损害了国家形象。

　　中国警方在加大打击此类犯罪力度的同时，还提醒广大民众注意以下事项：

　　(一)注意鉴别劳务中介机构资质。根据我国法律规定，从事对外劳务的中介机构，必须经工商部门核准登记后领取营业执照，依法取得劳动部门颁发的《职业介绍许可证》，及商务部颁发的《对外劳务合作经营资格证书》或劳动与社会保障部颁发的《境外就业中介经营许可证》。出国劳务人员应选择具备以上资证的中介机构办理相关手续。

　　(二)注意了解我国对外劳务输出的政策法规，关注相关部门发布的预警信息。目前，一些国家或地区与我国尚无国际劳务合作，向该国家或地区进行的劳务输出行为均为违法行为。根据商务、劳动等部门提供的预警信息，可以辨别中介公司劳务信息的真伪。

　　(三)在签订出国劳务合同时注意维护自己的合法权益。签订合同前应仔细阅读合同条款，提防其中的陷阱，在合同中应明确双方权利义务关系。同时保留好付款收据等证据，维护自己的合法权益。

　　(四)警惕劳务输出方面的虚假广告。面对各种媒体的此类广告宣传，要做到谨慎识别，理性判断，通过相关渠道向行业主管部门进行咨询，核实其真伪，切莫被虚假宣传蒙庇。
